Terms of Service

On Air Kit is operated by RMT Services OÜ, a private limited company registered in Estonia (registration code 16803586), with its registered address at Hobujaama 4, 10151 Tallinn, Estonia (“we,” “us,” or “our”). RMT Services OÜ also operates other products, including StreamerGiveaway and Stagey, under the same legal entity.

By creating an account, connecting a third-party identity, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

You provide a text description of a character, an uploaded photo, or both. We send that input to a third-party AI image-generation sub-processor (currently fal.ai, which may in turn route the request to underlying model providers such as Google's image-generation models depending on which model is used for a given generation) to produce the requested image. Our sub-processors may change over time as our infrastructure evolves; see our Privacy Policy for the current list.

The Service is provided on a free-to-browse, pay-to-generate basis: browsing styles, writing a description, and previewing a look costs nothing. Generating an image spends credits, described in Section 6 below.

You must be at least 13 years oldto use the Service, consistent with Twitch's own minimum age for its platform. If you are between 13 and the age of legal majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You can browse the Service, write a description, and attach reference photos without an account. Generating an image requires connecting a third-party identity, because that is the step that spends credits and needs somewhere to keep your finished work.

Twitch sign-in is available today. Discord and Google sign-in are planned but are not currently available — where our interface shows them, they are shown to be transparent about our roadmap, not because they are functional. We will update these Terms when that changes.

You are responsible for maintaining the security of the third-party account you use to sign in, and for all activity that occurs under your On Air Kit account.

Generating an image costs one or more credits, at a rate shown in the product before you generate. Newly arrived visitors may receive a small number of complimentary credits to try the Service before creating an account; complimentary credits are a promotional courtesy and may be changed, reduced, or discontinued at any time without notice.

Additional credits are purchased in packs through our payment processor, Stripe, at the price shown at the time of purchase. Our baseline anchor is $1 of purchase price per credit, with larger packs generally offering a lower effective price per credit; exact pack sizes and pricing are shown on the pricing page at checkout and may change over time. Stripe processes your payment details directly — we do not store your full card number.

Refunds. Credits that have already been spent on a completed generation are non-refundable, except where required by applicable law. If a generation fails to complete or does not deliver a usable result due to a technical fault on our side, contact us within 14 days of the failed generation and we will restore the spent credits.

Unused balances. Unless otherwise stated at the time of purchase, credits do not expire. If you close your account or we terminate it under Section 9, any unused credit balance is forfeited, except where applicable law requires otherwise.

If you delete your account, we sever your identity from your billing and credit history rather than deleting those records outright, so our financial accounts remain reconcilable and auditable as required by law — see our Privacy Policy for details.

You agree not to use the Service to:

You retain ownership of anything you upload — photos and text descriptions alike. By uploading, you grant us, and our AI processing sub-processor, a limited, non-exclusive licence to use it solely to generate the output you requested.

Subject to your compliance with these Terms — including the Acceptable Use section above — you own the images the Service generates for you and may use them commercially: on your stream, your Discord server, merchandise, or anywhere else.

Because the underlying image-generation model is a third-party AI system, we cannot guarantee that any specific output is free of any third party's pre-existing intellectual property. You are responsible for reviewing a generated image before using it commercially, consistent with the restriction on copyrighted characters in Section 7.

We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, including specific tools or generation models, at any time. We may also suspend or terminate an account that violates these Terms, particularly Section 7.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that generated output will meet your expectations or be usable on any specific platform.

To the maximum extent permitted by law, RMT Services OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, except where mandatory consumer protection law in your country of residence requires otherwise.

We may update these Terms from time to time. We will update the “Last updated” date above when we do, and material changes will be highlighted on the Service. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
